Terms & Conditions — Limitation of Liability and Disclaimer

1. Nature of the Platform. JobzaWorks ("the Platform," "we," "us") is an online marketplace that allows users to post jobs and connect with independent individuals who offer services ("Service Providers"). JobzaWorks is a venue only. We are not a party to any agreement between users, and we do not employ, supervise, direct, or control any Service Provider or Job Poster.

2. Independent Contractors. All Service Providers are independent contractors and are not employees, agents, partners, or representatives of JobzaWorks. JobzaWorks does not set the manner, method, or schedule of any work performed.

3. No Verification or Endorsement. JobzaWorks does not guarantee the identity, qualifications, licenses, insurance, background, skills, reliability, or conduct of any user. Any ratings, reviews, or profile information are provided by users and are not endorsed or verified by JobzaWorks. Users are solely responsible for conducting their own due diligence before engaging with others.

4. Identity Verification and POPIA. In terms of the Protection of Personal Information Act, 2013 ("POPIA"), JobzaWorks collects and stores personal information — including identity documents and photographs submitted by job applicants — solely for the purpose of account verification and platform safety. This information is stored securely, is accessible only to authorised platform administration, and is not sold or shared with third parties except where required by law. You may request access to, correction of, or deletion of your personal information by contacting us. Important: submission of verification documents and approval of a worker application do not constitute a guarantee, endorsement, or certification of any job seeker. Verification confirms only that documents were provided; it does not confirm identity, qualifications, trustworthiness, or suitability, and JobzaWorks accepts no liability arising from reliance on a user's verified status.

5. No Liability for Services. To the fullest extent permitted by law, JobzaWorks is not liable for the quality, safety, legality, timeliness, or completion of any work arranged through the Platform, or for any injury, death, property damage, theft, loss, or other harm arising from interactions between users, whether online or in person.

6. Payments and Disputes. Unless expressly stated otherwise, agreements on price, payment, and scope of work are made solely between users. JobzaWorks is not responsible for non-payment, overpayment, or any payment disputes. Users are encouraged to resolve disputes directly with one another.

7. Taxes and Legal Compliance. Service Providers are solely responsible for their own taxes, licenses, permits, insurance, and compliance with applicable laws. Job Posters are responsible for ensuring that the work they request is lawful.

8. Assumption of Risk. You acknowledge that using the Platform and meeting or working with other users involves inherent risks. You voluntarily assume all such risks and agree to take reasonable precautions for your personal safety and property.

9. Disclaimer of Warranties. The Platform is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, or error-free.

10. Limitation of Liability. To the maximum extent permitted by law, JobzaWorks and its owners, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Platform.

11. Indemnification. You agree to indemnify and hold harmless JobzaWorks and its owners, officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your dealings with other users, or your violation of these terms or any law.

12. Governing Law. This disclaimer is governed by the laws of the Republic of South Africa. Any dispute shall be resolved in the courts located in Cape Town, Western Cape, South Africa.

13. Severability and Changes. If any provision is found unenforceable, the remaining provisions remain in effect. We may update this disclaimer at any time, and continued use of the Platform constitutes acceptance of the changes.

14. Location. JobzaWorks operates from Cape Town, South Africa.
